Online - Bejeweled At Soul’s online website

Member - Refers to the account holder of a digital BeLoyal
account

Points - Has the meaning set out on Sections 4
& 5


2. THE PARTIES

2.1 The promoter of the programme is BeJeweled @
Soul Strabane Limited Company, Main Street, Strababne, Company Registration
Number: NI611175.

2.2 A Member is any person who has handed over their
information to our previous Loyalty Card programme, either instore or by
shopping online.

2.3 To become a Member, an applicant must become a
registered account holder by creating an account with a valid email address, or
completing registration in-store at BeJeweled At. Carried across from our old
Loyalty Card programme.

3. GENERAL

3.1 This page explains the terms of use on which
we operate our points loyalty programme and how to avail of your BeLoyal account.
Reference in these Terms and Conditions to “we”, “us”, “our” and “BeLoyal”
refers to BeJeweled At Soul, Strabane & www.bejeweledatsoul.com.

3.2 The BeLoyal Points programme is not a credit,
payment, or cheque guarantee.

3.3 BeJeweled At Soul may amend these Terms at
their discretion. BeJeweled At Soul will notify Members of any changes to these
Terms. If a Member uses their BeLoyal account following a change in the
Programme, the Member will be deemed to have accepted the change.

3.4 All Members must be at least 18 years old on
the date of creation of their Account.

3.5 BeJeweled At Soul reserves the right to
exclude allocation of points to brands and departments as they see fit.

3.6 BeJeweled At Soul BeLoyal programme cannot be
used on sale reduced goods or promotional items.

3.7 Members must personally produce a valid email
address connected to their own personal Beloyal account at BeJeweled At Soul,
when making a purchase to earn points on that purchase. BeLoyal accounts cannot
be shared or ‘clubbed together’.

3.8 For items held on deposit/layaway or Christmas
Club, no points will be earned.

3.9 The BeLoyal Member is obliged to notify BeJeweled
At Soul in writing of any change in the Member’s address or other relevant
Member details.

3.10 Points cannot be redeemed or earned on BeWeled
or Bespoke. Repair services and battery changes are also excluded from the Bejeweled
At Soul BeLoyal loyalty programme.

3.11 Points are not earned on the purchase of a
Gift Card/Voucher. The GV recipient will earn the BeLoyal points.

4. BeLoyal Membership

4.1 You can start collecting points straight away
providing oyu have provide us with a valid email address. Members may check
their points balance in-store at any till point, or online by logging on to
their account.

4.2 BeJeweled At Soul, at its discretion, may
offer bonus points to Members at certain times.

4.3 BeJeweled At Soul, at its discretion, may
suspend, alter, amend, or terminate the Programme at any time on giving
reasonable notice to Members. Notice may be given online, by letter, via social
platforms, through email communication to Members or by displaying notices
in-store.

5. OPERATING THE PROGRAMME

Earning Points

5.1 Points can be earned by Members: 1) on
purchases made in-store and online on eligible products; 2) by redemption of a valid
email address linked to a members account.

5.2 Points earned on in-store and online full
price transactions will be applied automatically.

5.3 Points cannot be earned by Members: 1) on the
purchase of Gift Card/s; 2) on delivery charges; 3) on in-store gratuities; 4)
on in-store repair services; 5) on any items not deemed to be eligible.

REDEEMING POINTS

5.5 Members can redeem points in-store &
online.

5.6 Points cannot be exchanged or redeemed for
cash or gift card/vouchers at any time.

5.7 BeJeweled At Soul has the right at its sole
discretion to determine from time-to-time which products and services are
eligible for Points and the number of Points that will be credited per
transaction.

5.7 Points have no monetary value and cannot be
sold, transferred or otherwise dealt with except in accordance with these
Terms.

Returns/Refunds/Deposits

5.8 On the return of any items that have been
allocated Points, the number of Points earned on that transaction - in regard
to the returned items only - shall be deducted from Member’s Account balance.
The deduction will occur when a refund is completed in accordance with BeJeweled
At Soul returns and refund policies.

5.9 If a Member has redeemed Points towards the
full or partial payment of an item that is subsequently returned, these Points
will be credited back to the Account at the time of the successful completion
of the return in accordance with BeJeweled At Soul returns and refund policies.

Points Expiry

5.10 No Expiry On BeLoyal Points. Subject to
change at BeJeweled At Soul discretion.

6. EFFECTIVE MEMBERSHIP ACCOUNT CANCELALTION OR PROGRAMME
TERMINATION

6.1 BeJeweled At Soul may cancel a Member’s
accumulated points or suspend the BeLoyal Loyalty Programme benefits, with
immediate effect and without written notice for any reason and at the
Promoter’s sole discretion, including, without limitation, if BeJeweled At Soul
believes the Member has:

(a) acted in a manner inconsistent with applicable
laws and regulations;

(b) acted in an inappropriate, fraudulent, abusive
or hostile manner;

(c) breached or violated any of the Programme’s
Terms and Conditions;

(d) fraudulently claimed eligibility to earn
points;

(e) engaged in misconduct or any wrongdoing in
connection with the Loyalty Programme.

6.2 The Loyalty Programme points, and other
related benefits and services are the sole property of BeJeweled At Soul and
are not the property of the Members. On cancellation of membership in the
Loyalty Programme for any reason, all unredeemed points will be forfeited, and
the Member will no longer be able to participate in the Loyalty Programme and BeJeweled
At Soul will not compensate or pay cash for any forfeited or unused points.

6.3 If BeJeweled At Soul cancels a Member’s
account for any reason, the Member may not reapply for membership in the
Loyalty Programme, except in limited circumstances at BeJeweled At Soul sole
discretion. Any account opened in the Member’s name and points earned in that
account will be forfeited upon discovery.

6.4 If a Member cancels their account or becomes
inactive, the Member may reapply for membership in the Loyalty Programme, but
no points previously forfeited or expired will be reinstated to the Member’s BeLoyal
account.

6.5 Members may
cancel their subscription to the Loyalty Programme at any point by
contacting The BeLoyal Team on weborders@bejeweledatsoul.com.

7. DATA PROTECTION NOTICE

7.1 Personal data supplied to BeJeweled At Soul (e.g.
name, address, email, telephone number) by a Member during the registration
process will only be processed by BeJeweled At Soul for the purposes set out
below and in accordance with our Privacy Policy. Other than as stated below, no
personal data will be divulged to any third parties outside of BeJeweled At
Soul or its data processors, unless required by law, or for us to comply with
our legal and regulatory obligations or the protection of our interests or for
defence against a legal claim.

7.2 Accounts and transactions may be monitored,
for us to comply with our legal and regulatory obligations.

7.3 BeJeweled At Soul can use the personal data
supplied by the Member in order to manage and administer the Programme and
improve the way the Programme is run; to help BeJeweled At Soul understand
Members’ shopping habits; to communicate information to Members; and to provide
Members with relevant tailored offers by email, SMS or post, unless the Member
opts out of the receipt of such offers in accordance with the Privacy Policy.
Members are responsible for reading the Company’s Privacy Statement available
at www.bejeweledatsoul.com in order to understand how the Company collects,
uses and discloses Member’s data. If a Member has any questions about the
Company’s Privacy Policy, the Member should contact office@bejeweledatsoul.com.

7.4 BeJeweled At Soul can also use information
relating to sets or groups of Members, without identifying Members, to enhance
its understanding of Member behaviour and enable BeJeweled At Soul to improve
its service in general.

7.5 Any request by a Member for a copy of their
data must be made, in writing, to the Data Protection Officer, at BeJeweled At
Soul, 51 Main Street, Strabane, BT828AU

8. LEGAL NOTICE

8.1 From agreeing registration, enrolling in our previous
BeJeweled At Soul Loyalty Card programme, or from the first use of the BeLoyal
programme, the Members’ agreement to these Terms and Conditions are implied.

9. SEVERABILITY

9.1 If any of the Terms and Conditions contained
herein affirm to be invalid, unenforceable, or illegal, then that term will be
deemed to be severed from the Agreement and the balance of the Terms and
Conditions will remain enforceable.

9.2 BeJeweled At Soul will have no liability to
each member for any loss, damage and either contract or otherwise in connection
with the operation of the Loyalty Programme.

10. MARKETING COMMUNICATIONS

10.1 By creating and using your BeLoyal account,
you agree and give permission to BeJeweled At Soul to send you relevant emails,
including but not limited to information about the Loyalty Programme,
promotional offers of new or existing products and updates regarding the
registration of the Programme. You can unsubscribe from our mailing list by
simply clicking the unsubscribe link at the bottom of any of our emails.
